By accepting these terms and conditions, you acknowledge entering into a legal and binding contract with Right-Way Auction Service. You agree to abide by all conditions provided, having received all necessary explanations and information.

PICK UP

• You are responsible for loading your items.
• Pick-up dates are by appointment or as specified for each lot.

PAYMENT

• Acceptable payments: cash, wire, cashier’s check, or credit card.
• Payment due within 24 hours.
• 10% Buyer's Premium applied to the winning bid.
• 3% convenience fee for credit card transactions.
• All property is sold “AS IS” and ALL SALES ARE FINAL.

SALES TAX

For the purposes of these Terms and Conditions:

• Sales tax applies per state laws based on item location and seller type.

AGENTS FOR SELLERS

• Right-Way Auction Service acts as an agent for sellers.
• Auctions are with reserve unless stated otherwise; reserves are undisclosed unless marked "Absolute."
• Auctioneers may place reserve bids on the seller's behalf, and final bids require seller confirmation.
• Only the top bidder will be notified of bid status.
• No warranties are expressed or implied; items are sold in As-Is-Where-Is condition.

INSPECTION

• Buyers are responsible for inspecting items personally or through a representative.
• By bidding, you agree to accept the item as-is, based on its provided description.

AUCTION CLOSE

• Timed-online auctions close at the specified date and time, remaining open until no bids are placed within the last 2 minutes.
• Multiple lots may close per minute at Right-Way’s discretion.
• Accepted bids transfer responsibility and risk for the item to the buyer immediately.
• Buyers bear costs related to item preparation, transport, and removal.

BUYER DEFAULT

• Bids are a firm commitment; retractions or cancellations are not permitted.
• Non-payment or fraudulent bids may lead to legal recourse and criminal charges.

INTERNET RISK

• Right-Way is not responsible for internet reliability or errors in online bidding.
• Auctions may be suspended, postponed, or canceled if internet service is unstable.
• Right-Way reserves the right to modify online services and auction terms at any time.
